Client Informed Consent & Liability Waiver

Voluntary Participation

I voluntarily choose to participate in services, sessions, events, classes, or programs at The Portal at Living Energy, located in Pismo Beach, California. I understand that participation is entirely voluntary and that I may stop or leave at any time.

Nature of Services

I understand that The Portal offers wellness, relaxation, spiritual, educational, complementary, and experiential services. I acknowledge that these services are not medical care, diagnosis, treatment, psychotherapy, psychiatric care, or emergency services.

Possible Reactions and Risks

I acknowledge that wellness, spiritual, and complementary services may involve physical, sensory, emotional, or psychological experiences. I understand that possible reactions during or following a session may include, but are not limited to: temporary soreness, muscle fatigue, dizziness, light-headedness, emotional release or heightened emotion, light sensitivity, sound sensitivity, skin sensitivity or redness, temporary headache, dry mouth, nausea, vivid dreams, unusual fatigue, or temporary aggravation of a pre-existing condition. These responses are generally temporary. In rare cases they may be more prolonged. I accept this possibility.

My Responsibilities

I accept full responsibility for disclosing to my session provider, practitioner, or class facilitator any relevant information that may affect the safety or appropriateness of a service, including but not limited to: medical conditions, prior surgeries, injuries, medications, implanted devices (including pacemakers, cochlear implants, insulin pumps, or neurostimulators), pregnancy or possibility of pregnancy, chronic illnesses, mental health history, seizure history, heart or cardiovascular conditions, cancer diagnosis or treatment, photosensitivity, skin conditions, hearing conditions, claustrophobia, trauma history, sensitivities, allergies, or any other health or safety concern.

I understand and accept that it is my responsibility - and my right - to stop, pause, or leave any service at any time if I feel discomfort, unusual symptoms, emotional overwhelm, or any concern about my safety or well-being. I agree to communicate clearly with my service provider.

I confirm that I am participating on behalf of myself, am at least 18 years of age, or (if a minor) that my legal guardian is providing this consent on my behalf and accepts all terms herein on behalf of the minor.

Release and Waiver of Liability

In consideration of being permitted to participate in services, sessions, events, classes, or activities at The Portal at Living Energy, I hereby release, discharge, covenant not to sue, and hold harmless: The Portal at Living Energy; its owner(s); officers; staff; employees; independent contractors; volunteers; practitioners; event hosts; facilitators; the property owner(s); landlord(s); building owner(s); the Don Day Trust; and each of their respective successors, heirs, assigns, agents, affiliates, and representatives (collectively, "Released Parties") from and against any and all claims, demands, actions, causes of action, losses, costs, expenses, attorney fees, injuries, damages, or liabilities of any kind arising from or in connection with my participation in any service, session, event, class, or activity at or through The Portal, to the fullest extent permitted by California law.

I understand that this release and waiver does not apply to claims arising from gross negligence, recklessness, intentional misconduct, willful or wanton acts, fraud, statutory violations, or any conduct or act that cannot legally be waived or released under California law.

No Guarantee of Results

I understand and accept that no specific outcome, result, improvement, healing, transformation, spiritual experience, or other benefit is guaranteed from any service, session, class, event, product, or program at or through The Portal.

Emergency Disclaimer

Services at The Portal are not intended for use in place of emergency care. In a medical emergency, mental health crisis, or safety emergency, I agree to call 911 or seek immediate assistance from licensed emergency services.

Severability

If any provision of this consent and waiver is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.

Acknowledgment

By completing a booking, registering for an event, or participating in any service, I confirm that I have read this entire Client Informed Consent and Liability Waiver, that I understand its terms, and that I voluntarily and knowingly agree to be bound by it. I agree that this waiver shall remain effective for all future sessions, events, and visits at The Portal unless I provide written notice of revocation.
